1. 15A NCAC 2Q .0317: AVOIDANCE CONDITIONS
for 15A NCAC 2D .1111: MAXIMUM ACHIEVABLE CONTROL TECHNOLOGY
a. In order to avoid applicability of 15A NCAC 2D .1111 and 40 CFR Part 63 Subpart JJJJJ “National Emission Standards for Hazardous Air Pollutants for Brick and Structural Clay Products", the Permittee shall restrict the operation rate of these sources (ID Nos. ES-1LK and ES-2LK) to less than 10 tons per hour fired product on a 12-month rolling average basis, beginning on May 16, 2006. Compliance with the 12-month rolling average of operation rate of these sources (ID Nos. ES-1LK and ES-2LK) shall begin on May 16, 2006 and for compliance purposes, the 12 months preceding May 16, 2006 shall be considered as zero value inputs for averaging purposes. Testing [15A NCAC 2D .0501(c)(4)]
b. If emissions testing is required, the Permittee shall perform such testing in accordance with 15A NCAC 2D .0501(c)(4) and General Condition JJ. If the results of this test are above the limit given in Section 2.2 D.1.a above, the Permittee shall be deemed in noncompliance with 15A NCAC 2Q .0317.
Monitoring/Recordkeeping [15A NCAC 2Q .0508(f)]
c. Beginning on May 16, 2006, the Permittee shall keep monthly records of these sources (ID Nos. ES-1LK and ES-2LK) operation rate and the calculations for 12-month rolling average for kiln operation rate, in a logbook (written or electronic format). The Permittee shall be deemed in noncompliance with 15A NCAC 2Q .0317, if the above records are not maintained.
Reporting [15A NCAC 2Q .0508(f)]
d. The Permittee shall submit a summary report of monitoring and recordkeeping activities postmarked on or before January 30 of each calendar year for the preceding six-month period between July and December and July 30 of each calendar year for the preceding six-month period between January and June.
