On 21 May 2004, Robert Kennedy, of the Fayetteville Regional Office Division of Air Quality performed an inspection of Purolator Products, Inc., located in Fayetteville, North Carolina. Upon request, additional information on Toluene and MIBK emissions were provided to this office. This data documented an exceedance of the toluene emission limit of 98 pounds per day during the month of February; however, the hourly toluene emissions were documented at less than half of the 14.4 pounds per hour limit. Your Air Permit No. 01757T16 (stipulation I.2.2.B.3) states:
PRIOR to exceeding any of these listed TPERs, the Permittee shall be responsible for obtaining a permit to emit TAPS and for demonstrating compliance with the requirements of 15A NCAC 2D.1100.
As stated in the "subject" above, this letter represents a Notice of Violation for failure to emit not more than 98 pounds of toluene daily at your facility. The above violation, and any future violation(s) of an air quality regulation are subject to the assessment of civil penalties according to North Carolina General Statute 143-215.114A. This General Statute provides that civil penalties of not more than ten thousand ($10,000) dollars may be assessed against any person who violates or fails to act in accordance with terms, conditions, or requirements of such permits pursuant to General Statute 143-715.114(a)(2). In addition, each instance of continuing violation after written notification from the Division of Air Quality will be considered a separate offense.
The Division of Air Quality requests that you, Purolator Products, Inc., consider pollution prevention as a potential way to reduce emissions from your facility. DPPEA and SBAP have experience personnel that provide free and confidential pollution prevention opportunity assessments to help North Carolina businesses and industries reduce air emissions and releases to other environmental media.
Please provide a written response addressing this violation by June 21, 2004. This response shall address the steps you have taken to maintain compliance with the toxic air pollutant limits in the air permit.
